Trade secret is a formula pattern, physical device, idea, process, compilation of information or other information that provides the owner of the information with a competitive advantage in the marketplace, and is treated in a way that can reasonably be expected to prevent the public or competitors from learning about it.
The law relating to Trade Secrets/Confidential Information/Commercial Secrecy is not well develop0ed in India. There is no legislation regulating this area of law. India follows common law approach of protection based on the case laws. However, there is no decision of the Honorable Supreme Court laying down the law. The decisions of the High Court involving the issues of Trade Secret were decided based on the Copyright/Design protection laws also. |
